AGREEMENT AND RELEASE OF LIABILITY
In contracting to participate in the rental and/or playing of paintball games with SEMPER FI PAINTBALL SUPPLY, I am completely aware of all of the risk involved and that there is the possibility of additional risk if the equipment provided by SEMPER FI should malfunction.

I am aware that participating in paintball games with SEMPER FI and/or private games with rental equipment from SEMPER FI, and all of the associated activities are hazardous activities and I am voluntarily participating in these activities with full knowledge of the danger involved and hereby agree to expect any and all risk of injury or death.

I indemnify SEMPER FI, its associates, and shall hold harmless from, any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorneys fees arising out of connected with or resulting from participating in any activity associated with paintball games and the use of equipment provided by SEMPER FI. Including without limitation the manufacture, selection, delivery, possession and use of the equipment and the premises which are provided to participate in games with SEMPER FI and assume all risks known and unknown.

I hereby waive all causes of action and release SEMPER FI employees, agents, and all of the others who participate with or against me from any liabilities, which may arise as the result of my participating in any paintball game activities. This release and waiver shall apply to my heirs, assigns, and estate.

I understand to always play the paintball games with SEMPER FI and/or private games with rental equipment supplied by SEMPER FI in accordance with the safety procedures, regulations, instructions, and suggestions presented at the safety meeting and/or posted on the signs at the paintball field. Furthermore, with full knowledge that any noncompliance are grounds for ejection from any games, and/or facilities temporary or permanently and without a refund.

Being aware of the intense physical and mental exertion required to play in paintball games, further warrant that I have no medical problems which such activity would aggravate and cause injury to myself or to others.

I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between me and SEMPER FI, its members, agents, and/or its affiliates and affiliated organizations and I sign of my free will.

Any parent/legal guardian renting a paintball gun for a child under the age of 18 for the use in playing private paintball games will take full responsibility for the safety of that child. The parent/legal guardian will supervise and insure all safety rules are strictly enforced. If the parent/legal guardian will be conducting private games with other minor children present they will take full responsibility for any and all injuries that might occur to the other children. The parent/legal guardian will take full responsibility for any other injured by the minor child.
